Adaptation of the Ukrainian energy efficiency and renewable sources of energy legislation to the EU legislation
One of the main componentsin engaging the economic system of Ukraine into the EU economic space is to achieve certain level of harmonization of our country’s legislation with the principles of the European Union law. Approximation of the Ukrainian legislation with the current European system of law will determine the development of political, business, social, cultural activities in the Ukrainian society.
The strategic focus on European integration, that Ukraine has declared and that has been implemented in practice in the recent years, necessitates putting more active efforts in the process of Ukrainian energy efficiency and RSE legislation adaptation with the EU legislation, that is one of important means in ensuring international competitiveness of the domestic economyas well as the tool and one of the prerequisites that hypothetically opens the opportunity of membership in the organizationand, at the same time, is an impetus for improvement of the own energy sector.
In Ukraine, the process of the Ukrainian energy legislation adaptation to the EU legislation (Acquis Communautaire) is rather of unilateral nature and is a voluntary step towards the EU, as Ukraine is not a member of the European Union and does not take part in the rule-making processes at the EU level.
Adaptation of the Ukraine’s legislation to the EU legislationis an international obligation stipulated by the Agreement on Partnership and Cooperation between Ukraine and the European Communities dated 14 June 1994, under which Ukraine commits to approximate its legislation to the Communities’ legislation in the priority spheres. Adaptation of the energy legislation is identified as a priority sphereinthe Law of Ukraine “Onthe National Programme of Ukraine’s LegislationAdaptation to the Legislation of the European Union”No. 1629-IV dated 18 March 2004.
The goal of the Ukraine’s legislation adaptation to the legislation of the European Union is to achieve compliance of the legislative framework of Ukraine withAcquisCommunautaireunder the criteria set by the European Union for the countries that intend toaccede the EU.
